Terms of Service
Last updated: 29 October 2026
1. Subject matter
WinitDay is a personal tool for organising tasks, calendar, habits, goals, training, time tracking, focus/break sessions, and — where available — a simple finance overview and a contacts network. WinitDay is not a financial service provider, bank, or broker, and does not provide investment or tax advice. These Terms govern use of WinitDay by registered users.
2. Pricing and payment
Use of WinitDay is currently free of charge; no payment is collected. Should WinitDay introduce a paid subscription in the future, the price stated on the website at that time will apply (incl. statutory VAT), billed in advance via a payment provider to be named. Existing users will be notified in good time before such a subscription is introduced and must separately agree to it.
3. Term and cancellation
While use remains free, you can delete your account yourself at any time via account settings. Should a paid subscription be introduced in the future, it will automatically renew for another month unless cancelled before the end of the current period; cancellation remains possible at any time the same way, effective at the end of the current billing period.
4. Consumer right of withdrawal
This section concerns a future paid subscription and has no effect while use of WinitDay remains free. Once such a subscription is introduced, consumers will have a statutory right of withdrawal: you may withdraw from the contract within 14 days without giving any reason. The withdrawal period begins on the day the contract is concluded. To exercise your right of withdrawal, you must inform us (kontakt@winitday.com) by means of a clear statement. By giving express consent to immediate performance, your right of withdrawal ends early once the contract has been fully performed.
5. Use at your own risk and limitation of liability
WinitDay is a private, free-of-charge hobby project with no commercial organisation behind it. You use WinitDay entirely at your own risk. We give no warranty of continuous availability, error-free operation, data security beyond what is described in the Privacy Policy, or fitness for any particular purpose. To the extent legally permitted, we are not liable for the loss, damage, or inaccuracy of data you enter into WinitDay yourself, nor for indirect damages, consequential damages, or lost profits.
This limitation of liability does not apply, and remains expressly unaffected, where the damage results from our intent or gross negligence, where it concerns damage arising from injury to life, body, or health, or where mandatory statutory consumer-protection provisions (in particular Austrian consumer law) or your rights under the GDPR preclude a broader limitation. Agreeing to these Terms is never a waiver of such mandatory rights — they cannot be validly excluded by a checkbox or by these Terms.
6. Permitted use
You may only use WinitDay lawfully and within the scope of these Terms. In particular, you may not access other accounts or data without authorisation, circumvent technical security measures, introduce malware, or take any action that materially impairs the operation or security of the service. You must ensure you are entitled to enter the content you store — this applies in particular to information about third parties in the Network feature (see Privacy Policy section 6).
7. Suspension and termination
In case of a material breach of these Terms or a concrete threat to the security of the service, we may temporarily restrict or suspend access to the extent necessary. We may discontinue the service for objective reasons; where legally required, we will notify you in advance and give you a reasonable opportunity to secure your data.
8. Changes to these Terms
We may amend these Terms with effect for the future. We will notify you of material changes by email in reasonable time before they take effect; where a change requires renewed consent, we will obtain it.
9. Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected.
